1. Acceptance of Terms
Welcome to the website and services of Alex Kuzmicz (“we”, “us”, or “our”), a Licensed Real Estate Salesperson with CENTURY 21 Synergy Realty Inc., Brokerage. By accessing https://alexottawa.com (the “Website”), utilizing our services, or subscribing to our communication programs, you agree to be bound by these Terms and Conditions (“Terms”).
If you do not agree to these Terms, you may not use our services or website.
2. Mobile Messaging Terms & Conditions (SMS)
This section specifically governs our text messaging program in compliance with A2P 10DLC standards.
Program Description:
Program Name: Alex Kuzmicz Real Estate Alerts
Program Type: Recurring message program
By providing your mobile phone number and express consent (e.g., via a web form, checkbox, or keyword), you agree to receive text messages from Alex Kuzmicz at the phone number you provided. Message frequency: Approximately 4-10 messages per month, depending on your activity, preferences, and market conditions. Messages may include commercial electronic messages (CEMs) such as property listings, buying and selling tips, market updates, transactional notifications, appointment reminders, and service-related communications.
Express Consent:
By subscribing to our text messaging service, you provide your express consent to receive messages from us. Your consent will remain valid until you withdraw it. You acknowledge that your consent is not a condition of purchasing any goods or services, unless the messaging service is directly related to that transaction.
Age Requirement: By opting in to receive text messages, you certify that you are 18 years of age or older, or have obtained parental or guardian consent to participate in this messaging program.
Message and Data Rates:
Standard message and data rates may apply based on your mobile carrier’s plan. Please contact your wireless carrier for pricing plans and details. You are responsible for all charges from your mobile carrier related to text messages.
Cancellation and Opt-Out:
You can cancel the SMS service at any time. Just text “DELETE” “STOP”, “UNSUBSCRIBE”, “END”, or “QUIT” to the short code or number you received messages from. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
Re-Subscription: If you opt back in after unsubscribing, you will need to provide express consent again through our opt-in process.
Help and Support:
If at any time you forget what keywords are supported, just text “HELP” or “INFO” to the number you received messages from. After you send the SMS message “HELP” to us, we will respond with instructions on how to use our service as well as how to unsubscribe. Supported Carriers & Liability:
Our text messaging service is available on participating Canadian carriers including Rogers, Bell, Telus, Freedom Mobile, and others. Carriers are not liable for delayed or undelivered messages.
We do not guarantee that text messages will be delivered to you in a timely manner or at all. Message delivery is subject to transmission limitations, network availability, and carrier practices. We are not liable for delays or failures in message delivery that are beyond our reasonable control.
Device Compatibility: This service is compatible with most mobile devices that support SMS text messaging. Some features may not be available on all devices or carriers.
3. Email Marketing Terms (CASL)
This section governs our email communication program in compliance with Canada’s Anti-Spam Legislation (CASL).
Program Description:
By providing your email address and express consent, you agree to receive email communications from Alex Kuzmicz. These may include “drip” campaigns, newsletters, market reports, property alerts, and other commercial electronic messages (CEMs).
Express Consent & Unsubscribing:
You consent to receive emails from us until you choose to withdraw your consent. You may unsubscribe at any time by clicking the “Unsubscribe” link found at the bottom of any commercial email we send. You may also contact us directly to request removal from our email list.
Delivery:
We strive to deliver relevant content to your inbox, but we cannot guarantee delivery due to spam filters, internet service provider restrictions, or other technical issues.

5. Intellectual Property

6. Prohibited Uses
You agree not to use our Website or communication services to:

Your continued use of the service after such changes constitutes your acceptance of the new Terms.
SMS Program Changes: If we make material changes to our SMS program terms, we will send you a text message notification. You will have the opportunity to opt out if you do not agree to the updated terms.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be resolved in the courts of Ontario.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
